Please note that our buying terms for the 2007/8 season incorporate the following trade contract terms unless specified otherwise on our purchase confirmation notes:

together with the following additional terms:-

Contract Tonnages

Our standard contracts are based on multiples of 29 tonnes; whilst we will and do buy other quantities we reserve the right to charge for any additional haulage costs incurred including capacity charges for any part loads.

Store Deliveries

We reserve the right to charge allowances or drying and cleaning charges on any loads delivered to our stores that exceed the following levels:

Grains15% moisture2% admixture
Pulses14% moisture2% admixture
Oilseeds9% moisture3% admixture

We reserve the right to charge for cooling crops that are delivered to store in excess of the following temperatures:
July / August25 degrees centigrade
September22 degrees centigrade
October onwards20 degrees centigrade

Details of charges are available on request.
If conditioning of any delivery is not reasonably practicable we reserve the right to reject the consignment.

Claims Notification

It is our policy with claims and rejections to try to contact suppliers by telephone but we reserve the right to use our best judgement should this not be possible. Claims of £3/t or less and contractual fallback claims will only be notified by fax or letter. Allowances on oilseed Rape will not be advised if they fall within the tolerances allowed in the FOSFA 26A contract.

Sample Collection and Insight Enquiry Services

Grainfarmers will operates its sample collection and analysis service. Growers are recommended to draw their own representative samples as per the HCGA guidelines.and for us to collect and analyse these in our regional laboratories. Results will be available via our 'Insight' online enquiry service. Mycotoxin Legislation

Please note from July 2006 new EU legal limits for mycotoxins, arising from fusarium infecting the ear and/or in poor storage conditions, will apply to grain intended for human consumption. The limits and guidelines on reducing the risks through husbandry and storage are available from the HGCA.

GMO

We MUST be advised in writing if you grow any genetically modified crops. Any such crops must not be allowed to contaminate non-GM crops, should contamination / contact occur we must be advised in writing immediately.

Sewage Sludge

Due to consumer restrictions on crops grown on land treated with sewage sludge we require that you declare any such crops at the time of sale.

Farm Assurance

To avoid rejections and delays we MUST be notified if your assurance status changes.

If such notification occurs after the sale date there will be a variation to the contract where the assured status no longer exists.

Weighbridge Charges

A weighbridge charge of £ 0.25p per tonne (plus VAT) will be levied on all deliveries / collections.

Linseed

FOSFA 9 clause 4 is excluded. Linseed is purchased basis max 9% moisture, max 2% admix, min 38% oil without reciprocal allowances unless otherwise agreed.

Payment

Unless otherwise agreed payment basis is 28 days from mean movement date.

Contra Payments

Grainfarmers plc shall be entitled but not obliged at any time without notice to you to set off any liability or monies due from you to Grainfarmers plc howsoever arising against any monies payable by Grainfarmers plc or any subsidiary or any holding company (as such expressions are defined in section 736 Companies Act 1985) of Grainfarmers Plc from time to time to you under any contract between Grainfarmers plc or any such subsidiary or any such holding company and you.

Growers Own Haulage

To Store: Vehicles should be fitted with an easy-sheet system unless it is possible to sheet and unsheet from ground level. Vehicles must comply with local site safety rules at all times. Vehicles must comply with the AIC haulage exclusion and contaminant sensitive list.

To End User Destinations: Vehicles must comply with the AIC Code of Practice for Road Haulage (of Combinable Crops, Animal Feed Materials, Compound Feeding Stuffs and As Grown Seeds). Vehicles must also comply with the end receiver's terms and site safety rules.
